STATUS: VICTORY!

 

YIMBY Law has filed suit against the city of Los Angeles for illegally delaying a 100% affordable housing proposal with a total of 190 homes. The project, located on Wilbur Ave in the Reseda neighborhood of Los Angeles, falls under the original form of Mayor Karen Bass’s Executive Directive 1 (ED1) which streamlines 100% affordable housing proposals. This marks YIMBY Law’s second lawsuit against the city for illegally delaying affordable housing proposals in single-family-only neighborhoods. (See full press release)

On December 17, 2024, the Los Angeles Superior Court published a tentative order that the City of Los Angeles did violate the HAA by illegally delaying a 100% affordable housing proposal. The Court will likely adopt the tentative order, meaning the housing proposal will return to the entitlement process and the City of Los Angeles will have to review and process the application under the original version of ED1, which allows multifamily housing in single-family-only zones. However, the Court did not find that the City acted in bad faith.
